Governor Kathy Hochul has officially established New York as the first state in the nation to enact a moratorium on new hyperscale data centers. The executive action halts the issuance of new environmental permits for such developments for a duration of up to one year.

This pause is intended to provide the state with time to evaluate the ecological and infrastructure impacts of large-scale computing facilities. While this measure is now active, the Governor's office is also currently reviewing a separate bill passed by the state legislature that could impose further restrictions on industry developments.

The move comes amid growing concerns regarding the energy consumption and environmental footprint of data centers required for cloud computing and artificial intelligence. Stakeholders are now awaiting further clarity on how the evaluation period will influence long-term zoning and permitting regulations across the state.
