The Maharashtra Cabinet, led by Chief Minister Devendra Fadnavis, has announced significant financial incentives to boost renewable energy initiatives. On Tuesday, August 11, 2026, the cabinet decided to eliminate stamp duty on internal land transfers between group or special purpose vehicle (SPV) companies. Additionally, a 25% discount on land transfer fees will be applied to these internal transfers.

These policy changes are intended to align with and accelerate the State Renewable Energy and Energy Storage Policy spanning from 2025 to 2035-36. The exemption from transfer duty, set at 25% of the land's market value, removes a previous financial burden that had been contributing to project delays.

To qualify for these benefits, the final use of the land must be exclusively for renewable energy development. The government has stipulated that if land acquired under this exemption is later diverted for other purposes, the waived fees will be reclaimed with interest. This condition aims to prevent misuse of the incentives.

Previously, when a parent renewable energy company transferred land to a subsidiary or SPV for project execution, stamp duty was levied on this internal transfer, effectively taxing the same land twice. The new policy addresses this by waiving the stamp duty, thereby reducing the overall cost of renewable energy production.

In a separate decision, the cabinet also revised the interest rate for delayed compensation payments in land acquisition cases. The new rate will be one percentage point higher than the interest rate at which the Reserve Bank of India (RBI) provides loans to commercial banks. This adjustment, amending Section 72 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act-2013, aims to provide fairer compensation to individuals affected by land acquisition delays, a situation that has previously led to years of waiting for payments.
